Chicago-land accident is subject of St. Clair County suit

A man claims he suffered great physical pain and mental anguish after a driver rear-ended the vehicle in which he was riding.

David C. Johnson filed a lawsuit Feb. 16 in St. Clair County Circuit Court against Shane D. Gornik and Timothy D. Johnson.

In his complaint, David C. Johnson claims he rode in a 1997 Chevrolet Conventional Cab Timothy Johnson drove north on Interstate 290 near its intersection with Higgins Road in Schaumburg on Feb. 25, 2010, when the accident occurred. Gornik, who was driving a 2003 Honda Civic in the same direction, failed to keep a proper lookout and struck the Chevrolet, according to the complaint.

In addition to the physical pain and mental anguish, David C. Johnson was hindered from attending to his normal duties and incurred medical costs, the suit states.

He blames Gornik for causing the collision, saying he negligently failed to keep his vehicle under proper control, drove too fast, failed to keep a proper lookout, failed to stop to avoid a collision and failed to adequately apply his brakes.

He also names Timothy D. Johnson as a defendant, saying he negligently failed to keep his vehicle under proper control and suddenly applied his brakes.

David C. Johnson seeks a judgment of more than $100,000, plus costs.
