Driver on drugs caused O'Fallon accident, suit claims

An O'Fallon woman says she was hit head-on by a Belleville man who was allegedly driving while on drugs.

Sharon and Michael DeBolt filed a lawsuit Feb. 15 in St. Clair County Circuit Court against David J. Tuley and Phyllis A. Braymen.

Sharon DeBolt says she was driving her Buick LeSabre east on West State Street in O'Fallon in December 2010. As she neared the 700 block, DeBolt says Tuley, driving a Honda CRV west on the same road, crossed the median and crashed into the LeSabre.

According to the complaint, Tuley was driving a car owned by Braymen, who is his mother. Debolt claims the driver was speeding and was under the influence of drugs at the time of the crash.

The DeBolts are suing Tuley and Braymen for negligence and loss of consortium. The couple is asking for ask for more than $200,000 in damages for medical expenses, loss of income and court fees.

They are represented by attorneys Judy L. Cates and Ryan J. Mahoney of The Cates Law Firm in Swansea.
