Woman sues insurance company for underpaying claim

A St. Clair County woman claims she incurred more than $15,000 worth of medical costs after a driver rear-ended her vehicle, but her insurance company refuses to reimburse her for her damages.

Katherine Showalter filed a lawsuit Jan. 31 in St. Clair County Circuit Court against Auto-Owner's Insurance.

In her complaint, Showalter alleges she drove her 1995 Chevrolet Monte Carlo east on Illinois 161 on Nov. 12, 2009, when Deborah Fleming, who was driving a 2007 Chevrolet Malibu in the same direction, struck her vehicle.

Showalter was able to receive $20,000 from Fleming's insurance company, but incurred more than $20,000 in medical costs due to the nervous system injuries she sustained during the collision, according to the complaint.

Showalter claims she was not at fault for the collision, saying Fleming negligently failed to stop or swerve to avoid a collision, failed to keep her vehicle under proper control, drove too fast, followed the vehicle in front of her too closely and failed to keep a proper lookout.

In her complaint, Showalter is seeking the medical costs she claims she incurred during the collision, plus a judgment of more than $50,000 and costs.
