Lawsuit accuses driver of being under the influence, causing Alton accident

A Madison County man says he was hit by another driver who was under the influence while driving in Alton.

Chadwick Attebery filed a lawsuit Feb. 6 in Madison County Circuit Court against Louise and Bradley M. Kincade.

According to the complaint, Attebery was hit while driving south on North Rodger Avenue in February 2010. As he crossed the intersection of Clifton Drive, Attebery says the Kincades' vehicle crashed into his. Attebery claims Louise Kincade was behind the wheel and ignored traffic signals that required her to stop at the intersection.

Attebery claims Louise was under the influence of drugs or alcohol at the time of the crash.

Attebery accuses the Kincades of negligence and asks for more than $50,000 in damages for medical bills, lost wages and court fees.

He is represented by attorneys S. Russell Meyer and Amy M. Meyer of Alton.
