Worker claims he was fired after filing comp claim

A former supervisor for an Alton company claims he lost his job after he attempted to file for workers' compensation benefits.

Robert Epps filed a lawsuit Jan. 31 in Madison County Circuit Court against Hanley Industries.

In his complaint, Epps claims he was working as a supervisor for Hanley when he sustained leg and arm injuries on March 4, 2010. Following his injuries, Hanley sought medical treatment and was not able to return to work for one week, according to the complaint.

On Jan. 11, 2011, Epps filed for workers' compensation benefits so he could be reimbursed for his medical costs, the suit states. On Jan. 26, 2011, Epps was fired from his job, the complaint says.

"The termination of the Plaintiff's employment with the Defendant is casually related and intended by the Defendant in retaliation for Plaintiff's pursuit of his remedies under the Workers' Compensation Act," the suit states.

In his two-count complaint, Epps seeks a judgment of more than $300,000, plus costs.

Samuel A. Mormino of Mormino, Velloff, Edmonds and Snider in Alton will be representing him.
