Owners of China House Buffet in Maryville sued over missed rent

An Illinois corporation claims a Chinese restaurant owes it more than $50,000 in missed rental payments.

Collinsville Acquisitions filed a lawsuit Jan. 20 in Madison County Circuit Court against Zhen Zheng and Ying Lin, both owners of China House Buffet.

In its complaint, Collinsville Acquisitions alleges it leased 6,000 square feet of space at 10 Fieldcrest Dr. in Maryville to Zheng and Lin. Under the terms of the lease, the defendants agreed to pay $120,000 per year to rent the premises from March 7, 2007, and continuing for at least five years, according to the complaint.

However, Zheng and Lin stopped making payments beginning on Oct. 1, the suit states.

"Through January 16, 2012, Tenants owe CA approximately $55,594.23 in rent and charges," the complaint says.

The defendants also owe $70,000 for future rent payments it promised to make but failed to pay, Collinsville Acquisitions claims.

CA alleges breach of contract against Zheng and Lin.

In addition to the money it says the defendants owe it, CA seeks attorneys' fees, costs, interest and other relief the court deems just.

Christopher W. Byron and Micah S. Summers of Byron, Carlson, Petri and Kalb in Edwardsville will be representing it.
