Heirs sued over 2009 auto accident

A claim has been filed against the estate of a Marissa man accused of owing money after a 2009 traffic crash.

Brian Sommer filed the complaint against the estate of Richard E. Timmons on Dec. 8 in St. Clair County Circuit Court. Timmons' wife, Peggy L. Timmons, along with his known and unknown heirs are also listed as defendants.

Sommer says he was involved in a traffic crash with Richard Timmons in December 2009. He says he filed a claim against Timmons' insurance policy for personal injuries allegedly caused by the crash. That liability claim has allegedly not been resolved.

Sommer says he recently learned Timmons passed away in August 2010, leaving no will. The driver is now bringing the personal injury claim against Timmons' estate and asking the Court to appoint a special representative to defend the action.

Sommer is asking an expedited hearing be made to appoint the representative so that the appointment can be made quickly.
