Catholic Church in Edwardsville sued over equipment lease
A lender has filed suit against the church that it claims failed to pay it more than $100,000 for equipment borrowed.
CIT Technology Financing Services claims it lent office equipment to defendant St. Boniface Catholic Church on June 10, 2008. St. Boniface agreed to lease the equipment for 60 months at $1,895 per month, according to the complaint filed Nov. 22 in Madison County Circuit Court.
In a second lease agreement, the church agreed to lease office equipment from CIT for $495 per month for a period of 60 months beginning on July 17, 2008, the suit states.
However, the church failed to abide by both agreements, the complaint says.
Because of its breach of the June 10 agreement, the church owes CIT $117,592.12, CIT claims. As a result of its alleged second breach of agreement, the church owes CIT $28,581.59, according to the complaint.
"The Plaintiff, CIT Technology Financing Services has made numerous demands for payment upon the defendant and the defendant has refused and continues to refuse payment," the suit states.
In addition to the money it says it is owed, CIT is seeking interest, fees, costs and other relief the court deems just.
