Moro excavating company sues over unpaid equipment rental

A Moro excavating rental company is suing a golf course construction company for allegedly refusing to pay rental fees and damaging the equipment.

Richard W. Gvillo Jr., doing business as Gvillo Trucking and Excavating, filed the lawsuit Nov. 8 in Madison County Circuit Court against Bryant Midwest Corporation.

According to the complaint, Gvillo Trucking rented a tractor and a scrapper to Bryant Midwest Corp. in March. Gvillo says the company agreed to pay $125 per hour for use of the equipment.

Gvillo claims the equipment had to to be recovered in August because it was not returned in a timely manner. He says the meter showed Bryant used the tractor for nearly 350 hours. He says Bryant also caused nearly $73,000 in damage to the machinery.

Gvillo alleges Bryant has paid only $9,500 of the more than $34,000 it owes for the use of the equipment.

He says the construction company has also refused to pay for all repairs made.

Gvillo is suing Bryant Midwest Corp. for breach of contract, damage to property and lost profits. The company is asking for for nearly $250,000 in damages along with court costs.
