Taxi passenger sues driver over accident injuries

A man claims he sustained injuries to his neck and jaw after an allegedly intoxicated driver struck the driver's side of the taxi cab in which the man was riding.

Lucas I. Mihalich filed a lawsuit Nov. 2 in Madison County Circuit Court against Julie A. Tuck.

In his complaint, Mihalich claims he was riding in a cab that was traveling east on Amelia at its intersection with Washington Street in Alton on Dec. 15, 2009, at about 10:25 p.m. when Tuck, who was driving south on Washington Street, hit the taxi.

In addition to his injuries, Mihalich was hindered from performing his normal activities, incurred medical costs and lost large sums of money, according to the complaint.

He blames Tuck for causing the collision, saying she negligently failed to yield at the intersection, drove while intoxicated and failed to keep a proper lookout.

In his complaint, Mihalich seeks a judgment of more than $50,000 and punitive of more than $50,000, plus costs.
