Woman claims injuries in Highway 50 accident

A Belleville woman claims she sustained head, jaw and mouth injuries after a driver failed to yield the right-of-way at a stop sign.

Stacy M. Martin filed a lawsuit Sept. 19 in St. Clair County Circuit Court against Michael P. Henry.

In her complaint, Martin alleges she drove east on East Highway 50 and was attempting to make a left turn onto Scott Troy Road in O'Fallon on Oct. 13, 2009, when Henry, who was driving west on the highway, failed to yield the right-of-way at a stop light and struck her vehicle.

In addition to her injuries, Martin incurred medical costs and experienced pain and suffering because of the collision, the suit states.

Martin blames Henry for causing the collision, saying he negligently failed to keep a proper lookout, failed to keep his vehicle under proper control, failed to reduce or decrease his speed at an intersection and failed to properly apply his brakes.

In her complaint, Martin seeks a judgment of more than $50,000, plus costs.

Patrick R. Foley of Williams, Caponi and Foley in Belleville will be representing her.

St. Clair County Circuit Court case number: 11-L-531.
