A man claims he suffered severe and permanent injuries after he slipped on ice while attempting to make a delivery.
Julius K. Holtgrave filed a lawsuit Aug. 24 in St. Clair County Circuit Court against Landshire.
In his complaint, Holtgrave alleges he was delivering food products for his employer, Holtgrave Distributing, on Jan. 6, 2010, when he encountered ice while at Landshire in Emporia, Kan.
Because of his fall, Holtgrave suffered great mental and physical pain and anguish and was restricted in his physical activities, according to the complaint. In addition, he lost earnings and sustained an impaired earning capacity, the suit states.
Holtgrave blames Landshire for causing his fall, alleging it allowed ice to exist for an unusually lengthy period of time, failed to correct the accumulation of the ice, failed to provide a safe entrance and exit and failed to provide a safe working area, the complaint says.
In his complaint, Holtgrave seeks a judgment of more than $50,000, plus costs and other relief the court deems just.
