Dale G. Frische has filed suit against David G. Biedenbach claiming the defendant has failed to comply with a settlement agreement reached in September 2010.
According to the complaint filed June 21 in St. Clair County Circuit Court, Biedenbach made five payments pursuant to the agreement between Sept. 1 and Dec. 9 totaling $15,500.
"Defendant, David G. Biedenbach, has failed to timely pay the balance of $13,000 and thus treble damages of $39,000 on this balance," the complaint states.
Frische is seeking $52,000 in damages, plus other and further relief as deemed proper by the court.
He is represented by Michael L. McGlynn of Belleville.
