Ruth to open wrongful death trial over man's heart attack death Monday

Madison County Circuit Judge Dennis Ruth is set to open the trial of a wrongful death case brought against a doctor, a medical practice, and Alton Memorial Hospital over a man's death from a heart issue.

Ruth is set to open the trial of the suit brought by Kimberly Collman at 9 a.m. Monday with jury selection.

Kimberly Collman is suing Dr. Shazia Rani Chaudhry, Alton Memorial Hospital, and BC Illinois Emergency Physicians LLP on behalf of her husband, Mark Collman, and her own behalf.

Collman alleges that Chaudhry failed to recognize the symptoms of a dissected aorta when Mark Collman arrived at the Alton emergency room in March 2006.

Kimberly Collman alleges her husband died as a result of the defendant's negligence and failure to check x-rays and other tests.

The defendants deny the claims.

The hospital and BC Illinois are being sued as the doctor's superiors.

The plaintiff seeks damages in excess of $75,000 and other relief.

Ruth oversaw the suit's pre-trial earlier this week.

Motions in limine are pending in the case including a July 13 motion filed by Kimberly Collman asking Ruth to ban mention of payments she may have received after her husband's death and any mention of an "alleged medical malpractice crisis or judicial hell-hole."

Samantha Unsell and Thomas Keefe Jr. represent the plaintiff.

Terese Drew represents Chaudhry and her practice.

Dede Zupanci represents the hospital.

The case is Madison case number 08-L-112.
