Condo association sues State Farm over unpaid damage claim

A Collinsville homeowners association is suing State Farm Insurance for allegedly failing to pay for hail and wind damage.

The Townes at Woodland Park Condominium Association filed the complaint June 7 in Madison County Circuit Court against State Farm Fire and Casualty Company.

The Association says it purchased an insurance coverage from State Farm in September 2008. According to the complaint, the policy covered three buildings containing condominium units on Pine Lake Road in Collinsville. The Association says the policy covered loss or damage including "accidental direct physical loss."

In June 2009, hail and rain allegedly caused roof damage to buildings at the Townes at Woodland Park Condominiums. The Association says that caused subsequent damage to the interior of several units.

According to the complaint, the insurance policy was in effect at the time of the storm but State Farm has allegedly refused to pay for the damage. The Association claims the insurance company denied the claims citing a "faulty roof" as the reason.

The Association accuses State Farm Fire and Casualty Company of a breach of contract. It is asking for damages of more than $50,000 along with attorney fees and court costs.
