Olin worker says he was terminated after comp claim

A Belleville man claims he lost his job because he filed for workers' compensation benefits after sustaining an injury while working.

Christopher Sands filed a lawsuit June 15 in Madison County Circuit Court against Olin Corporation.

In his complaint, Sands claims he sustained accidental injuries on Sept. 15 and Nov. 4 while working at Olin Corporation. After the injuries, Sands filed a claim under the Illinois Workers' Compensation Act, sought medical treatment, took time off and received benefits, according to the complaint.

On Dec. 17, Olin terminated Sands, saying his position was being eliminated, the lawsuit states. However, Sands argues he was fired in retaliation for his filing for workers' compensation benefits.

Because of his job loss, Sands lost wages, insurance coverage, vacation and sick time and 401(k) benefits and experienced pain, suffering and emotional distress, the suit states.

In his two-count complaint, Sands seeks a judgment of more than $50,000 and punitive damages of more than $50,000, plus costs.

Thomas C. Rich and Kristina D. Cooksey of Fairview Heights will be representing him.

Madison County Circuit Court case number: 11-L-565.
