Caytown Convenience blamed for man's torn rotator cuff

A man claims he suffered from a torn rotator cuff after slipping on frozen ice.

Robert Geaschel filed a lawsuit May 16 in St. Clair County Circuit Court against Brett Alan Carnes doing business as Brett's Caytown Convenience.

In his complaint, Geaschel claims he visited the convenience store located at 421 S. Main St. in Caseyville on Jan. 20 at about 4 p.m. when he slipped on ice in front of the establishment.

"That the defendant knowingly allowed certain water to accumulate and freeze from a gutter that was dripping and falling to the sidewalk, causing the plaintiff to slip and fall," the suit states.

In addition to his torn rotator cuff, Geaschel sustained an injury to his left shoulder and suffered disability, according to the complaint. In addition, he experienced pain and suffering and incurred medical costs, the suit states.

Geaschel blames Brett's Caytown Convenience for causing his injuries, saying the store negligently failed to warn him of dangerous conditions and knowingly allowed water to freeze and accumulate on its sidewalk.

In his complaint, Geaschel seeks a judgment of more than $50,000, plus costs.
