Hawaiian man sues insurers over Madison County accident

A man from Hawaii is suing multiple insurance companies for allegedly failing to pay claims after he was hurt in a car crash in Madison County.

Robert Patton filed the lawsuit May 25 in Madison County Circuit Court against Twin City Fire Insurance Company and Hartford Financial Services Group Inc. Geico General Insurance Company, Geico Indemnity Company and Geico Casualty Company are also named as defendants.

According to the complaint, Patton was driving his mother's Buick on Great River Road in October 2009. As he approached Clifton Terrace Road, Patton says he was hit by Daniel W. Zimmerman who had allegedly failed to stop, as required, at the intersection. Patton claims Zimmerman was using his cell phone and was distracted at the time of the crash.

Because Zimmerman was allegedly under-insured, Patton says he tried to collect losses from the companies the driver was covered by at the time of the crash.

Patton alleges Twin City Insurance, which carried a policy on the Buick, and Hartford Financial Services, the parent company of Twin City, have refused to pay his claims. Geico Insurance, which insures Patton, has also allegedly failed to pay.

Patton accuses the insurance companies of breach of contract, refusal to pay and breach of duty of good faith. He is asking for more than $750,000 in damages plus court costs.

Attorney E. Ryan Bradley of Clayton, Mo. is representing Patton. They ask for a jury trial.
