Helper claims Bobcat operator struck him during yard work

A man has filed suit against the owner of property where he claims he was struck by a Bobcat machine, causing him to fall and sustain serious injuries.

Richard Lewis claims he was helping defendant Thomas A. Davis install railroad ties at Davis' property at 513 East O'Fallon Dr. in Caseyville on April 2, 2010, when the incident occurred.

"Defendant Thomas A. Davis's operation of a 'Bobcat' or other similar machinery caused Plaintiff Richard Lewis to be struck, resulting in Plaintiff Richard Lewis being knocked off his feet and thrown to the ground," the suit filed May 12 in St. Clair County Circuit Court states.

Because of his fall, Lewis suffered severe and permanent injuries, was hindered from attending to his normal duties and suffered great pain and anguish, according to the complaint. In addition, he incurred medical costs, the complaint says.

In his complaint, Lewis blames Davis for negligently failing to properly operate a Bobcat, for failing to inspect a Bobcat to make sure it's in working order and for failing to keep a proper lookout while operating the Bobcat.

In his complaint, Lewis is seeking a judgment of more than $50,000, plus costs.
