Sara Buske moves to drop accounting firm from suit against divorce attorneys

Sara Buske's 2010 malpractice case against her divorce attorneys and accountants is one defendant lighter.

Madison County Chief Judge Ann Callis approved a May 27 motion to dismiss RSM McGladrey, a St. Louis-based accounting firm, from the suit she filed against RSM and the Feldman, Wasser, Draper & Cox, a Springfield law firm.

Callis signed the order dismissing the accounting firm June 1.

Sara Buske sued RSM and the Feldman firm in 2010 claiming that both defendants bungled matters related to her 2008 divorce from her then-husband, Thomas Buske.

According to the May 27 filing, the plaintiff is seeking to voluntarily dismiss RSM "because the suit is not yet ripe for determination."

Callis is set to hear a motion to compel Sara Buske filed May 25 on June 10 at 9 a.m.
RSM, as well as the Feldman firm, had moved to dismiss the suit.

Sara Buske's 2010 malpractice suit stems from her divorce.

Sara Buske filed for divorce eight days after a Wisconsin court entered a $203.8 million
civil judgment against Thomas Buske.

The judgment was entered in favor of S.C. Johnson and Sons Inc.

S.C. Johnson had contended that Thomas Buske defrauded it using inflated invoices from his trucking companies.

Howard Feldman, of the Feldman firm, represented Sara Buske in the divorce.

S.C. Johnson moved to intervene in the divorce alleging it was a ruse devised to shelter
Thomas Buske's assets from the Wisconsin judgment.

S.C. Johnson sought to use the Buskes' prenuptial agreement as proof of its arguments but the parties settled before the document was produced in the record.

Sara Buske received $325,000 under the settlement.

A trust containing $425,000 was set up for the Buskes' children.

Thomas Buske was allowed to keep $50,000 in personal property.

S.C. Johnson received the rest of the Buske assets.

Sara Buske filed suit against her attorneys and RSM last year.

In that suit, she alleged that Howard Feldman mishandled the prenuptial agreement issue and cost her settlement moneys.

She alleged that RSM gave her bad tax advice during her divorce.

Callis is the third judge to handle the suit since its filing.

The first two, Madison County Circuit Judges Andreas Matoesian and William Mudge, bowed
out.

In the motion to compel, Sara Buske alleges that the Feldman firm has not responded to interrogatories or requests for production. She asks the court to compel answers from the defendant within ten days of the June 10 hearing.

Jonathan King and Al Pranaitis represent RSM.

Vicki Cochran represented Thomas Buske in the divorce.

Andrew Velloff and Thomas Keefe Jr. represented S.C. Johnson in the divorce.

Madison County Associate Judges Duane Bailey and Thomas Chapman both oversaw the Buske divorce. Chapman oversaw its 2009 settlement.

The case is Madison case number 10-L-1211.
