Route 4 accident in Marine results in injuries, suit claims

A woman has filed suit against the driver who she claims overturned her vehicle, causing a collision.

Danielle L. Frank claims she was riding in a vehicle traveling south on Route 4 about 288 feet south of Gilomen Road in Marine on Dec. 4, 2009, at about 8:32 p.m. when the collision occurred.

"At the aforementioned time and place, the defendant, Nicolette Groce, failed to keep her car under control, causing it to over turn and causing a collision to occur and injury to the plaintiff, Danielle L. Frank," the suit filed April 12 in Madison County Circuit Court states.

Because of the collision, Frank became sick, sore, lame, disordered and disabled and sustained injuries to her neck, back and arm, the complaint says. In addition, she claims she incurred medical costs, suffered disability, experienced pain and suffering and lost wages and her earning capacity.

Groce negligently failed to properly apply her brakes, drove too fast and drove without adequate brakes, according to the complaint.

In her suit, Frank is seeking a judgment of more than $50,000, plus costs.

She will be represented by John H. Hustava of Collinsville.

Madison County Circuit Court case number: 11-L-368.
