Madison County Circuit Judge William Mudge is set to consider a sanctions move on the same day as he holds a pre-trial in a suit over a woman's slip down basement stairs in Granite City.
Plaintiff Christina Whitford is suing Brian Stanley, the owner of the home where she allegedly slipped on wet stairs, fell and injured her shoulder and left arm in 2008.
She seeks damages in excess of $50,000 and costs.
Stanley denies that he negligently maintained his property.
Whitford moved for sanctions in the 2010 suit March 28.
Mudge is set to take up the move together with the suit's pre-trial conference April 14 at 9 a.m.
The suit is currently set for trial April 18.
According to the sanctions motion, Stanley has failed to produce documents and other responses to the plaintiff's discovery requests.
Whitford cites a pattern of attempts to get the items she requested beginning in August 2010.
She claims that even though Stanley has produced parts of what she has asked for, he has "engaged in acts of willful and wanton non-compliance of the laws and rules of the State of Illinois regarding discovery."
Whitford asks Mudge to hold the defendant in contempt of court, strike his previous pleadings, and grant her attorney's fees.
The defendant has not responded as yet to the sanctions move according to the case file.
