Spa failed to make rent payments, suit claims

Spa Rinnovi has failed to pay more than $30,000 worth of rent installments and prorated utility payments, according to a recently filed lawsuit.

SK Hosto filed a lawsuit Feb. 8 in Madison County Circuit Court against Spa Rinnovi, Amy L. Pierard and Kelly J. Wagner.

The suit also claims Spa Rinnovi owes more than $50,000 in late payments.

SK Hosto claims Spa Rinnovi breached the terms of a lease it entered into on Aug. 1, 2009, to rent premises at 10 Edwardsville Professional Park.

According to the complaint, Spa Rinnovi agreed to pay Hosto a minimum rent of $45,900 in 17 monthly payments of $2,700, plus its prorated share of utilities.

However, Spa Rinnovi has failed to make rent payments, to pay its prorated share of utilities and to make late payments, the suit states.

"As of Feb. 8, 2007, Rinnovi has failed to make rent payments totaling $10,092.31 and has failed to make utility payments totaling $1,093.28," the complaint says.

Not only did Rinnovi fail to make the payments due under the terms of its lease, but it also has not paid rent for March through December, SK Hosto claims. Rent payments due for the missed 10 months total $27,000, according to the complaint.

Because of its missed rent payment, Rinnovi owes $56,150 in late charges, the suit states.

Rinnovi is also wanting to terminate its lease agreement and its insurance coverage on the premises, the complaint says.

SK Hosto names Pierard and Wagner as defendants because it says they signed court documents guaranteeing the payment of rent, but failed to make the due payments.

In addition to the money it says Rinnovi owes it, SK Hosto seeks a judgment of more than $150,000, plus attorneys' fees and costs.

Michael J. Hertz of Lucco, Brown, Threlkeld and Dawson in Edwardsville will be representing it.
