Panera sues Morton contractor over Peoria incident in Madison Couny

A St. Louis-based business is suing a Morton, Ill. contractor over the concrete job it did at a Peoria bakery, in Madison County.

Panera LLC, also known as St. Louis Bread Co., is suing Clifford Kaufman & Sons Inc. for allegedly installing unstable concrete in its patio.

The suit filed Feb. 2 claims that Panera hired Kaufman & Sons to do concrete work on the bakery's West Bird Boulevard location.

The company claims the concrete was installed improperly, allowing it to become weathered and weakened. Panera says Kaufman & Sons failed to correct the problem.

In February 2009 a customer allegedly fell. Panera says the uneven concrete is to blame.

Panera says it settled an injury claim with the customer and now seeks an undisclosed amount of money from Kaufman & Sons, arguing the concrete contractor is liable for the woman's fall.

Attorneys Donald J. Ohl and Patrick J. Madigan of Edwardsville are representing Panera. They request a jury trial.
