Milburn School Road accident is subject of suit

A woman claims she sustained bruises and contusions more than three years ago after a driver failed to yield the right-of-way to her at a stop sign.

Megan M. Bigham filed a lawsuit Jan. 10 in St. Clair County Circuit Court against Russell F. Barthelemy.

According to Bigham's suit, she rode in a vehicle traveling east on Milburn School Road near Old Collinsville Road in Fairview Heights on Sept. 18, 2007, when Barthelemy, who drove west on the same road, failed to obey a traffic control device and struck the vehicle in which she rode.

Because of the collision, in addition to Bigham's injuries, she became sore and disabled, suffered pain and incurred medical costs, the suit states.

Bigham blames Barthelemy for causing the collision, saying he negligently failed to maintain a proper lookout, drove too fast, drove without adequate brakes, failed to properly apply his brakes, drove without a working horn and failed to yield the right-of-way.

In addition, Barthelemy failed to keep his vehicle under control, failed to stop or swerve to avoid a collision, failed to bring his vehicle to a complete stop and failed to provide Bigham with at least one-half the road, according to the complaint.

In her complaint, Bigham seeks a judgment of more than $50,000, plus costs.
