Jury awards $8k to woman in Alton car accident suit; $6k of total for pain and suffering

A woman injured in an Alton car accident seven years ago has won $8,602 in damages following a two day damages trial this week.

Jurors deliberated for about an hour Wednesday before awarding plaintiff Margaret Davenport the $8,602.

Davenport had asked for over $11,000 for what she claimed were medical bills related to the accident.

Attorney Paul Travous acknowledged that his client, Jason Krankle, was at fault in the 2002 accident but argued that some of Davenport's medical bills related to problems with her neck and back that were unrelated to the accident.

Davenport claimed to have injured her neck and back after Krankle hit the car she was riding in.

The case had been dropped but then refiled.

Krankle admitted to fault in the incident.

The trial opened Tuesday with jury selection, opening statements, and testimony in the plaintiff's case.

Those testifying included Gerald Bemis, a chiropractor, Henry Campbell, the driver of the car Davenport rode in, and her treating doctors.

The damages in the case were $1,000 for the loss of a normal life, $6,000 for pain and suffering, and $1,602 for medical bills.

Madison County Chief Judge Ann Callis presided.

The case is Madison case number 09-L-935.
