Hylla allows company time to fix service issues in 'Holiday Magic' suit

An Edwardsville company suing the St. Louis Convention and Visitors Commission (SLCVC) over a broken contract related to its "Holiday Magic" events has been given time to fix service issues.

Madison County Circuit Judge David Hylla signed an order Friday allowing plaintiff Experiencing Imagination Inc. time to amend its suit and properly serve the SLCVC over the defendant's objections.

Hylla found that the plaintiff had failed to serve SLCVC with its breach of contract suit within the mandated 30 days.

Experiencing Imagination is suing the SLCVC for damages in excess of $100,000 and other relief.

The plaintiff claims that the visitors commission improperly severed its contract with Experiencing Imaginations for event services the plaintiff was to provide for the defendants' Holiday Magic events through next year.

The defense is moving to dismiss the suit for lack of personal jurisdiction because it is based in Missouri.

Hylla did not take up the jurisdiction issue Friday.

Timothy Stubblefield represents the plaintiff.

J. Steven Erickson represents the SLCVC.
