Move to dismiss "Holiday Magic" breach of contract case in court

Madison County Circuit Judge David Hylla is set to hear a motion to dismiss a suit brought over St. Louis' "Holiday Magic" event.

The St. Louis Convention and Visitors Commission (SLCVC) is moving to have the suit brought by Edwardsville-based Experiencing Imagination dismissed for lack of personal jurisdiction.

Hylla is set to hear the motion on Friday at 9:30 a.m.

Experiencing Imagination filed suit claiming that it was contracted to supply event services and materials for the SLCVC "Holiday Magic" events through 2011.

The company claims that the commission broke its contract without paying required fees.

The plaintiff is seeking damages over $130,000, attorney's fees and costs.

The defendant claims that as a Missouri-based organization, the Madison County court lacks jurisdiction to decide the matter.

J. Steven Erickson has filed a limited appearance for the SLCVC and will represent the commission in the dismissal matter.

Timothy Stubblefield represents the plaintiff.

The case is Madison case number 10-L-688.
