Jury selection got under way Tuesday morning in a suit over injuries and property damages caused by a 2007 tractor trailer accident on a highway in Ste. Genevieve County, Mo.
Plaintiffs Thomas and Betty Edwards are suing Gary Collier and his employer, Millstadt Rendering Co., for damages in excess of $50,000 and costs.
The Edwardses claim that Collier, while driving a Millstadt truck, lost part of his tractor trailer and crossed into Thomas Edwards' lane of traffic.
Thomas Edwards, also driving a truck for his employer Slay
Transportation Inc., collided with a spilled container.
Thomas Edwards had to be cut from his vehicle and was severely injured in the crash.
Claims for contribution filed by Millstadt against Slay remain pending.
Slay acknowledged its respondent superior liability in the event of a contribution finding against Thomas Edwards.
Collier and Millstadt claim that Thomas Edwards could have slowed down to avoid the collision and that effects of his diabetes could have played a part in the accident.
The trial's Monday start was delayed by pre-trial motions and motions in limine.
Callis heard and decided those issues Monday afternoon.
Jury selection started at 9 a.m. Tuesday.
Voir dire was still on-going at 4 p.m.
