Parties move to continue rear end accident trial set Monday

The parties in a Collinsville rear-end accident case are asking Madison County Circuit Judge Dennis Ruth to push off its Monday trial date.

Attorney Christopher Hantla, who represents defendant Cynthia Maddaleno, asked for the continuance Oct. 6, citing another trial he has scheduled in St. Louis County on the same day.

Maddaleno is being sued by Constance Wagner for damages in excess of $50,000 and costs.

Wagner claims that Maddaleno failed to watch out, failed to slow down and did not drive carefully enough to avoid rear-ending Wagner's car on Beltline Road in Collinsville on May 14, 2006.

The defendant denies the claims.

In her answer filed in November 2009, Maddaleno claims that an unknown male driver caused the accident by changing lanes improperly in front of Wagner, causing her to slam on her brakes without giving Maddaleno time to stop before the collision.

Monday's trial is currently set to begin at 9 a.m.

The case is Madison case number 08-L-411.
