A woman has filed suit against the railroad where she claims her husband was exposed to hazardous chemicals, causing him to develop cancer and die.
Toni Solano claims John Michael Solano worked for BNSF Railway Company from 1975 until 2007.
Throughout his tenure with the company, John Michael Solano was exposed to carcinogenic materials and developed cancer, according to the complaint filed Aug. 13 in Madison County Circuit Court.
Before his death, John Michael Solano suffered pain and anguish, incurred medical bills and lost earnings, the suit states.
Toni Solano claims because of her husband's death, she was deprived of his financial assistance, support, care, counsel, guidance, training and education.
BNSF Railway negligently failed to provide BNSF with a safe place to work, failed to provide safe work conditions, failed to provide safe work methods, failed to provide safe and proper equipment, failed to provide proper respiratory equipment and failed to warn of the hazardous properties of the chemicals John Michael Solano was using, the complaint says.
In her complaint, Toni Solano is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
