Callis to hold pre-trial in rear-end accident suit
Madison County Chief Judge Ann Callis will preside over a pre-trial conference in a rear-end accident suit Sept. 3.
Meanwhile, the defendant in the suit, Albin Rak III, recently changed his answer in the suit brought by plaintiff Kris Rowe.
In his amended answer, Rak III now claims responsibility for rear-ending and injuring Rowe in October 2007.
Rak III had previously denied liability in the case.
The suit is currently set for trial Sept. 20 at 9 a.m.
Next week's pre-trial conference is set for 9 a.m. as well.
In his suit, Rowe claims that both he and Rak III were driving east on I-270 when Rak III rear-ended Rowe's car.
Rowe claims the defendant was negligent in failing to keep a look out, failing to control his car and for other reasons.
The suit seeks at least $50,000 in damages and costs.
Callis took over the case last December from Madison County Circuit Judge Daniel Stack.
The change was part of a shifting of cases that occurred after Stack announced his plans to retire later this year.
Rowe is represented by Philip Rice of Belleville.
Rak III is represented by John Cunningham of Belleville.
The case is Madison case number 09-L-269.
