O'Fallon business sued over lease payments

A company has filed suit against the O'Fallon business that it claims has failed to make a rent payment since January.

HW Investments Group claims it leased property at 210 Hartman Lane, Suite 300 in O'Fallon to defendants MMR Enterprises doing business as Goin' Postal, Michael Reed, Misty Reed and Renwick T. Ware.

Under the terms of the lease, dated Dec. 6, 2006, the defendants agreed to pay HW $1,700 per month for 61 months, according to the complaint filed June 3 in St. Clair County Circuit Court. The initial term of the contract was for 121 months, and the rent for the remaining months was set forth in the contract, but not specified in the lawsuit.

"Defendants have failed to perform their obligations under the Contract in that Defendants have failed to pay Plaintiff the enumerated monthly lease payment ($1,700) from January 1, 2010, to the present," the suit states.

Despite HW's demands for payment of the money, the defendants have refused to make payments to the company, the complaint says.

"As a direct and proximate result of Defendant's breach as described above, Plaintiff has been damaged in the principal amount of at least $130,100," the suit states.

In addition to the money it says it is owed, HW is seeking late payments, pre-judgment interest, costs, attorney's fees, all expenses it incurred in attempting to relet the premises and other relief the court deems just.

HW will be represented by Hrant 'Hud' Norsigian Jr. of Norsigian Law Office in O'Fallon.
