A woman has filed suit against a financial company and a repossession company, alleging she was wrongly arrested in front of her minor son after the repossessors falsely accused her of waving a hand gun at them when they attempted to take her vehicle.

Leticia D. Jackson claims she purchased a vehicle from defendant Drive Financial Services and got behind on her monthly payments. When Leticia Jackson purchased the vehicle, she made an agreement with Drive that if she happened to fall behind on her payments, her vehicle would not be repossessed and payments would be rendered, according to the complaint filed June 7 in St. Clair County Circuit Court.

Despite the alleged agreement, Drive sent defendant Arch Recovery Services to repossess Leticia Jackson's vehicle on Oct. 29, the suit states.

"That during the course of this attempted repossession, the above-mentioned two employees of Defendant Arch Recovery Services, without justification, falsely accused Plaintiff of having a hand gun and pointing same at them reporting same to the Shiloh Police Department," the complaint says.

Shiloh police arrived, arrested and hand-cuffed Leticia Jackson in front of her minor son and co-plaintiff, Christian Jackson, she claims. Later, on the way to the police station, the officers learned the charges were false and returned Leticia Jackson to her residence, according to the complaint.

Because of the incident, Leticia Jackson experienced pain and suffering, embarrassment and physical injury, the suit states. In addition, her son suffered emotional damages that may require him to seek medical assistance, the complaint says.

In her six-count complaint, Leticia Jackson is seeking a judgment of more than $200,000, compensatory damages of more than $100,000 and punitive damages of more than $150,000, plus costs.
