Freeburg accident is subject of suit

A woman claims she sustained injuries to various parts of her body after an alleged drunken driver struck her.

Ashley R. Herzog filed a lawsuit April 14 in St. Clair County Circuit Court against Kyle R. Nolte.

Herzog claims she drove south on South State Street near it intersection with Commerce Drive in Freeburg when Nolte, who also drove south on the same street, rear-ended her vehicle.

Because of the accident, in addition to her injuries, Herzog suffered pain and permanent disability, incurred medical costs and lost wages, according to the complaint.

She blames Nolte for causing the collision, saying he drove while under the influence of intoxicating liquor, drove too fast, drove on the left side of the road, failed to keep a proper lookout and failed to stop or swerve to avoid a collision, the suit states.

Herzog seeks a judgment of more than $50,000, plus costs.

Brad L. Badgley of Belleville will be representing her.

St. Clair County Circuit Court case number: 10-L-174.
