Two people have filed suit against the allegedly intoxicated driver who they say struck them as they were riding on their Yamaha motorcycle.

Jason E. Kempfer claims he was driving a 1997 Yamaha motorcycle north on Scott Troy Road in St. Clair County on Oct. 2, 2009, at about 3:15 a.m. when defendant Oliver P. Walker, who was driving a 1994 Chrysler LHS south on the same road, struck him.

Before the collision, Walker had consumed and become intoxicated off liquor he had been served at co-defendant's Joseph Redmond's doing business of Joe-Man's Chicken Shack, according to the complaint filed April 12 in St. Clair County Circuit Court.

Because of the collision, Jason E. Kempfer sustained severe and permanent injuries, endured great physical and mental pain and anguish and suffered great physical disability and disfigurement, according to the complaint. In addition, he lost his enjoyment of life, was hindered and prevented from attending to his usual duties and affairs, lost large sums of money and incurred substantial medical costs, the suit states.

Co-plaintiff Stacey L. Kempfer says she lost large sums of money in financial support and incurred medical costs to treat Jason E. Kempfer.

The Kempfers blame Walker for causing the accident, saying he negligently drove his vehicle into an oncoming lane of traffic, failed to keep his automobile under control, failed to see the Kempfers' vehicle and failed to stop in time to avoid a collision.

In their three-count complaint, the Kempfers are seeking a judgment in excess of $150,000, plus costs.

They will be represented by Dennis M. Field of Strellis and Field in Waterloo.
