Charter sued over employee's auto accident

An O'Fallon man has filed suit against the driver who he claims failed to stop at a red light and struck him.

Dennis Ponder claims he was driving northeast on East Main Street at its intersection with Illinois Route 161 in Belleville on April 6, 2008, at about 1:26 p.m. when defendant Benjamin T. Daniel, who was driving a Ford Econoline van owned by co-defendant Charter Communications northwest on Illinois Route 161, failed to stop at a red light governing the intersection and crashed into Ponder.

Because of the collision, Ponder's vehicle was knocked into a building, causing the right side and front end of Ponder's vehicle to sustain $2,000 worth of damages, according to the complaint filed March 31 in St. Clair County Circuit Court. In addition, Ponder incurred medical costs of more than $15,000, sustained pain and suffering and experienced permanent and disabling injuries, the suit states.

Daniel negligently failed to decrease his speed when approaching an intersection, failed to reduce his speed to avoid an accident, failed to keep a careful lookout, drove too fast, failed to stop at an intersection controlled by a red light and drove into an intersection controlled by a red light, the complaint says.

In his 12-count suit, Ponder is seeking a judgment of more than $600,000, plus costs.
