Mine subsidence not disclosed, homeowner says in suit

A woman claims the people who sold her her Swansea home failed to disclose defects on the property before she purchased it.

Vasiliki Pride filed a lawsuit March 18 in St. Clair County Circuit Court against Mary A. Thomas, Lisa Thomas, Strano and Associates and Drewola Ferrell.

Pride claims she agreed to purchase a home at 205 Aspen in Swansea from the defendants on March 22, 2005.

Before selling the home, when they filled out the real property disclosure report, Mary A. and Lisa Thomas indicated they remained unaware of mine subsidence, underground pits, settlement, sliding, upheaval or other earth stability defects on the premises, according to the complaint. However, the home did suffer from such defects at the time the Thomases completed the report, the suit states.

The Thomases and their real estate agent, Ferrell of Strano and Associates, knew of the defects and had an obligation to reveal them, the complaint says.

As a result, Pride claims she suffered unspecified damages.

In the three-count complaint, Pride seeks compensatory and punitive damages of more than $150,000, plus costs.
