Saw lacerates man's face, suit filed against Home Depot, Makita

A man claims he suffered severe facial lacerations after a saw struck him in the face.

Dennis and Tracy Soto filed a lawsuit March 4 in Madison County Circuit Court against Home Depot U.S.A. and Makita U.S.A.

The Sotos allege Dennis Soto was operating a Makita DPC731 saw on March 16, 2008, when a hose became disconnected from the saw, causing the saw to jerk into his face.

Because of the incident, Dennis Soto suffered severe lacerations to his face; experienced physical pain, mental suffering, mental anguish and distress; became permanently prevented from attending to his usual affairs and duties; and lost wages, according to the complaint. In addition, he incurred medical costs, the suit states.

Tracy Soto claims she lost her husband's consortium due to his injuries.

The Sotos blame Home Depot and Makita for causing Dennis Soto's injuries, saying when the saw left their possession, it wrongly utilized a plastic hose and coupler connection for use with brass hose fittings and the plastic hose and coupler connection disconnected from the saw due to vibration.

In their four-count complaint, the Sotos seek a judgment of more than $200,000, plus costs.
