ATV driver failed to navigate turn, woman claims in suit

A Belleville woman claims she sustained a fractured leg after an all-terrain vehicle flipped and landed on top of her.

Courtney Klemme filed a lawsuit March 1 in St. Clair County Circuit Court against Corey Eyman.

Klemme claims she rode on a Polaris Ranger Eyman drove in Millstadt on July 26, 2008, when the vehicle flipped and partially landed on Klemme's body.

Because of the accident, Klemme became sick, sore, lame, disordered and disabled; suffered a fractured fibula and abdominal injuries; incurred medical costs; suffered disability; experienced pain and suffering; and lost wages, according to the complaint.

She blames Eyman for causing the accident, saying he failed to keep his vehicle under proper control, failed to apply his brakes and failed to reduce his speed while approaching or navigating a turn.

Klemme seeks a judgment of more than $50,000, plus costs.

James R. Williams of the Law Offices of Williams, Caponi, Foley and Eckert in Belleville will be representing her.

St. Clair County Circuit Court case number: 10-L-94.
