Icy Glen Carbon driveway leads to lawsuit

A man claims he sustained right foot and leg injuries after falling on ice on a Glen Carbon driveway.

Seth Sherl filed a lawsuit March 8 in Madison County Circuit Court against John and Mary Mucho, Jason and Kristen Schnur and The Orchards Homeowners' Association.

Sherl claims he visited a residence at 13 Arbor Lane in Glen Carbon on Jan. 9 and, while walking on a driveway at the premises, slipped on a patch of snow and ice.

Sherl's fall caused him to become sick, sore, lame, disordered and disabled; to incur medical costs; to suffer disability; to experience pain and suffering; and to lose wages, according to the complaint.

Sherl blames the Muchos and the association, who own the property, and the Schnurs, who rent the premises, for his fall, saying they failed to provide him a safe place, failed to provide a safe means of ingress and egress, allowed the driveway to become snowy and icy, failed to inspect the premises to make sure it remained in a good condition and failed to warn Sherl of the dangerous condition.

In his five-count suit, Sherl seeks a judgment of more than $250,000, plus costs.
