Plumbing company failed to warn by-standers on use of shovels, suit claims
A man has filed suit against a plumbing and heating company, alleging one of its workers hit him in the knee with a shovel.
Aaron Bricker claims he was working at the McDonald's located at 2 Airport Rd. in Bethalto on June 8, 2008. At the same time, Hubert Plumbing and Heating Company was working on the premises when one of its employees struck Bricker in the knee with a shovel, according to the complaint filed March 1 in Madison County Circuit Court.
Because of the incident, Bricker suffered injuries to his knees, experienced pain and suffering, sustained disability, incurred medical costs and lost wages, the suit states.
Hubert Plumbing and Heating Company employees negligently failed to adequately block off the work area, failed to properly supervise employees in their use of equipment and failed to warn by-standers of the use of shovels, the complaint says.
Bricker seeks an unspecified judgment in excess of the minimum jurisdictional limit of Madison County Circuit Court, plus costs.
He will be represented by Lance R. Mallon and Dawna M. Hale of Mallon and Hale in Wood River.
