Netco class action suit set for case management

A class action suit over real estate fees is set for case management Feb. 24.

Lead plaintiffs Kerry and Sheila Tormino are suing on behalf of borrowers who were allegedly charged higher fees than necessary for records and courier services by Netco.

Several class action suits were filed between 2003 and 2005 in Madison County over fees charged in real estate transactions.

The case management conference is set for 9 a.m.

In their complaint, the Torminos allege that Netco charged them a larger fee than it paid for records and courier services in order to pocket the difference.

The suit seeks damages on claims of unjust enrichment, breach of fiduciary responsibility, violations of the state's consumer fraud act, and breach of contract.

The case had been assigned to then-Madison County Circuit Judge George Moran.

It is currently assigned to Madison County Circuit Judge Barbara Crowder.

The plaintiffs and class are represented by Philip Bock.

The defendant is represented by Edward Bott.

The case is Madison case number 04-L-238.
