Fetal distress not detected, says suit against obstetrician and hospital

A Collinsville woman claims her daughter died after a doctor at Anderson Hospital allegedly failed to provide proper pre-natal care.

Meghan Fernandez filed a lawsuit Jan. 19 in Madison County Circuit Court against Dr. Christina Midkiff and Southwestern Illinois Health Facilities doing business as Anderson Hospital.

Fernandez claims she began seeing Midkiff in March 2007 for prenatal care, labor and delivery of her expected child, Keira Fernandez.

"During the course of Defendant's care and treatment of Plaintiff, Defendant breached her duty of care in one or more of the following respects: (a) Defendant failed to adequately monitor or assess the fetal viability during the pregnancy, in light of the mother's existing conditions; (b) failed to properly treat the mother's existing conditions, including diabetes, in order to properly ensure proper fetal development; and/or (c) Defendant failed to adequately or timely intervene when the fetus became distressed," the suit states.

As a result, Keira Fernandez died on Dec. 26, 2007, according to the complaint.

Because of her daughter's death, Meghan Fernandez has suffered personal and pecuniary losses, including the loss and companionship of her daughter, the complaint says.

In her eight-count suit, Meghan Fernandez seeks a judgment of more than $400,000, plus costs and other relief the court deems just.
