Trial set for Monday in Alton car crash suit

Madison County Circuit Judge David Hylla is set to open a car accident trial on Monday.

The plaintiff in the case, Steven Kirk, alleges that Enver Hamiti injured him when Hamiti's car collided with his in 2006.

According to the court docket, the trial is scheduled to begin at 9 a.m.

Hylla entered an order Tuesday deciding several pre-trial issues brought up at a pre-trial conference Nov. 6.

According to his complaint, Hamiti failed to yield, failed to keep a lookout and failed to stop at a stop sign, causing the crash.

Kirk's suit seeks damages in excess of $50,000 and costs for his injuries and medical bills.

Hamiti alleges in his answer that Kirk contributed to the accident.

According the Nov. 10 order, Hylla reserved his judgment on some of the outstanding issues in the case after a hearing last Friday. He denied a plaintiff's motion to have jurors view the Alton accident scene and denied another plaintiff's motion to exclude the testimony of one Evan Baden, although he reserved judgment on the scope of Baden's possible testimony.

Hylla granted in part and denied in part a defense motion in limine to bar the inclusion of a statement Hamiti made to Allstate Insurance Company. Hylla granted a defense motion to take a witness out of order.

Kirk is represented by Amy Meyer of Alton and Chris Kolker of Belleville.

Hamiti is represented by Mark Kurz of Belleville.

The case is Madison case number 07-L-165.
