Step collapsed at apartment, says man in suit
A man and woman claim the man was injured when a step collapsed beneath him.
Scott and Priscilla Donals filed a lawsuit Oct. 16 in Madison County Circuit Court against Joseph E. Meyer, Joseph E. Meyer and Associates, Dean Huntley, Huntley Inspection Services and Robin Kilpatrick.
The Donals claim Scott Donals was walking down the stairs in an apartment building located at 309 South Kansas in Edwardsville when he fell after a step collapsed on May 20, 2008.
Because of his fall, Scott Donals suffered severe and permanent injuries, incurred pain and suffering, became responsible for medical costs and sustained a disability and loss of a normal life, according to the complaint. In addition, he suffered disfigurement, including mental and physical injury, and lost wages, the suit states.
Priscilla Donals is suing because she lost consortium and incurred medical costs in taking care of Scott Donals, the complaint says.
The Donals blame the defendants for failing to thoroughly inspect and repair the stairs prior to the incident, for failing to hire competent repair people to fix the steps, for failing to have stairs in compliant with certain codes and for allowing dangerous steps that were cracked and full of knots.
In the six-count suit, the Donals are seeking a judgment of more than $300,000, plus costs.
