A motorcyclist alleges he received a brain injury after after hitting a hole in the road, causing him to crash.
Jacob R. Ormond claims he was driving his motorcycle on Homer Adams Parkway West near its intersection with West Delmar in Godfrey on Oct. 13 when he "went in and over" a hole in the road.
According to the complaint filed Sept. 17 in Madison County Circuit Court, the hole Ormond hit existed because defendants Roadsafe Traffic Systems and Charles E. Mahoney Co. were repairing road reflectors.
However, while repairing the road reflectors, both defendants failed to provide warnings of road construction and dangers, failed to adequately repair the road, failed to fill in areas of the road that had been dug out for repairs and failed to warn the public of the hole in the road, the suit states.
In addition, the defendants allegedly failed to inspect the work of its subcontractor, Roadsafe.
As a result of his hitting the hole, Ormond suffered impaired vision, loss of visual acuity, pain, loss of wages, disability and a diminished earning capacity and incurred medical costs, the complaint says.
In the three-count suit, Ormond is seeking an unspecified judgment, plus costs.
Christ Brothers Asphalt has been named as a respondent in discovery. Ormond claims the company may have essential information as to whom should be named as additional defendants.
