Woman seeks repayment of $150k promissory note

A woman says a St. Clair County man owes her $150,000 after he failed to make payments on his promissory note.

Cynthia J. Mueller-Heimann filed a lawsuit Aug. 25 in St. Clair County Circuit Court against Phillip L. Yarber.

Mueller-Heimann claims she loaned $150,000 to Yarber on Feb. 8.

Under the terms of the promissory note, Yarber agreed to repay the money, plus interest, in 120 equal monthly installments of $1,665.31 beginning on March 1, according to the complaint.

However, Yarber has made no payments to Mueller-Heimann, even though she has demanded reimbursement, the suit states.

In addition to the money she says she is owed, Mueller-Heimann is seeking interest, costs, attorney's fees and other relief the court deems just.

Stanley M. Brandmeyer of Brandmeyer Law Offices in New Baden will be representing her.

St. Clair County Circuit Court case number: 09-L-447.
