Shiloh accident is subject of suit

A Belleville woman is suing the driver of a vehicle that she claims crashed into her while she was driving on Green Mount Road.

Tina Bivins filed a lawsuit July 2 in St. Clair County Circuit Court against Heidi Huff.

Bivins claims she was driving a 2004 Volkswagon Jetta north on Green Mount Road near its intersection with Frank Scott Parkway in Shiloh when the incident occurred on Aug. 21, 2007, at about 7:08 a.m.

As Bivins was driving, Huff, who was operating a 2006 Nissan Sentra in the same direction, collided with her, according to the complaint.

As a result of the accident, numerous parts of Bivins's body and
nervous system were injured, she lost income and she suffered pain and discomfort, the suit states. She also incurred medical expenses, has been physically limited and incurred substantial damages to her vehicle, the complaint says.

Huff negligently failed to keep a proper lookout, failed to keep her vehicle under control, failed to stop or swerve to avoid a collision, failed to stop, drove too fast for the road conditions and failed to reduce her speed as she was approaching an intersection, Bivins alleges.

Bivins is seeking a judgment of more than $50,000, plus costs.

Nathan C. Lanter of Nelson and Nelson in Belleville will be representing her.

St. Clair County Circuit Court case number: 09-L-358.
