North Illinois Street accident is subject of suit

A woman has filed suit against the driver of a 2002 Subaru Forester who she says failed to stop for traffic and crashed into the car in which she was riding.

Sherrell D. Graber says she was a passenger in a 2006 Ford Fusion that was traveling south on North Illinois Street in Swansea on July 2, 2007. The vehicle in which Graber was riding was stopped at a red light at North Illinois Street's intersection with Green Haven, according to the complaint filed July 1 in St. Clair County Circuit Court.

Without warning, defendant Andrea R. Blackmer, who was driving the Subaru behind the vehicle in which Graber was riding, failed to stop and crashed into the back of the vehicle, the suit states.

Because of the accident, Graber endured disability, disfigurement, pain and suffering, plus she incurred medical costs and aggravated a pre-existing medical condition, the complaint says.

Blackmer drove too fast, failed to reduce her speed to avoid a collision, failed to stop her vehicle to avoid a collision, failed to keep a proper lookout, failed to keep her vehicle under control and failed to use ordinary care to avoid a collision, Graber claims.
Graber is seeking a judgment of more than $50,000, plus costs.

Dennis J. Graber of Belleville will be representing her.

St. Clair County Circuit Court case number: 09-L-354.
